Terms And Conditions

The Buyer agrees to pay the outstanding balance through a certified check or money order upon receipt of the goods, confirming the receipt of a finalized version of this purchase order. For deliveries outside the continental U.S., full payment is required prior to shipment, as COD is not available. This quote excludes sales tax, import duties, brokerage fees, installation, and anchor bolts. Under no circumstances should the driver be given cash for any remaining balance on the building. The Buyer’s purchase order will only be deemed legally binding once it has been approved in writing by an authorized representative of ICON. The Project Manager who prepares this order is not an officer of ICON and does not have the authority to accept the order on behalf of ICON. If the order is accepted, a signed “Acceptance” copy will be returned to the Buyer; otherwise, the initial payment will be refunded. Upon acceptance of the order, the Buyer relinquishes the right to claim any refund on the initial payment made to ICON’s Project Manager. If there are delays not caused by ICON, any increases in steel prices, materials, or shipping costs after the requested delivery date will be passed on to the Buyer. The Buyer will be informed of such changes through a Change Order detailing the new pricing. The Buyer must approve the changes by signing the Change Order or may choose to cancel the contract, but they will still be responsible for any work completed and materials ordered prior to the cancellation date. Complete terms and conditions can be reviewed at www.iconsteelbuildings.com and are incorporated by reference. Any items not specifically mentioned in this proposal, such as foundation design or anchor bolts, are excluded from the quoted pricing.

Any alterations or modifications made to the structure after installation will void the responsibility of U.S. Structural Steel for the unit, which includes its warranty and certification. The building will come equipped with anchor bolts intended for concrete installation.

CONCRETE DESIGN DISCLOUSURE

The design of the slab and foundation provided is specifically tailored for structural purposes. However, it does not consider several important factors, including the concrete’s strength for long-term durability, moisture or vapor barriers, specifications for subbase materials, installation methodologies, or requirements for thermal insulation. It is advisable to seek the guidance of a qualified professional for any aspects not addressed in this design.

1. Activation of Contract

This Purchase Order, along with these Terms and Conditions, becomes a binding agreement once it has been accepted in writing by an authorized representative of the Seller. After acceptance, neither party has the right to cancel the agreement.

2. Payment Terms

The timing and conditions for payment are crucial. The costs associated with the goods and services detailed in the Purchase Order or any written change order must be followed. For items that are custom-manufactured, prepayment in full or in part may be required. The Seller reserves the right to request advance payment for manufacturing or delivery. If there are any concerns regarding the Buyer’s creditworthiness, the Seller may insist on prepayment before continuing with the order.

3. Specifications for Purchased Goods

a. At the request of the Buyer, the Seller may provide drawings, including anchor bolt layouts and cross-sections, for approval. A duplicate will be sent for the Buyer’s review, and any requested changes must be submitted within 30 days. Following receipt of approved drawings, the Seller will create detailed shop drawings and commence production.

b. Changes requested must be formalized through a written Change Order, which both parties must sign, specifying the alterations and any cost implications.

c. The dimensions provided are estimates. External measurements are standardized, and final dimensions may differ due to factors such as the concrete base.

Unless stated otherwise, the goods will be shipped FOB (Free on Board) to the location designated by the Buyer, transferring title and risk of loss to the Buyer upon delivery. Should the Buyer cause any delays, they will assume the cost and risks related to the storage of the goods and must pay the full contract price along with any additional storage and shipping costs.

The Seller is not liable for any indirect or special damages arising from delivery delays due to uncontrollable factors such as natural disasters, labor disputes, or shortages of materials.
