Terms and Conditions

INSTALLATION AND SALE AGREEMENT

This Installation and Sale Agreement (this “Agreement”) is entered into by and between Icon Steel Buildings (“ISBC”) and the individual listed on the last page (the “Customer” or “You”), effective as of the date written below.

This Agreement contains very important information regarding your rights and obligations, as well as conditions, limitations, and exclusions that apply to your purchase. Please read it carefully.


1. SITE INSTRUCTIONS AND REQUIREMENTS

2. Anchoring

  • All units must be secured with concrete anchors (for concrete foundations) or recommended cross-drive anchors (for ground or gravel foundations).

  • If ISBC is unable to install the recommended ground anchors due to hard-packed soil or solid rock, the Customer will be responsible for installing concrete pier footings to secure the unit properly.

  • Rebar anchors are for temporary use only on ground installations. ISBC will be released from all liability for any damage to the structure or property if the Customer chooses to use only rebar anchors.

  • Failure to use the proper recommended anchoring methods will void all warranties.


3. Foundations

Standard foundations for anchoring are ground, gravel, asphalt, or concrete. Any other type of foundation may incur additional installation fees. Please consult an ISBC representative for details.

a. Standard Installation – Concrete (No Additional Fees):

  • Concrete foundations must measure 6″ wider and 6″ longer than the physical footprint of the unit.

  • Example: A 12′ x 21′ building (20′ base rail) requires a foundation measuring at least 12′6″ wide x 20′6″ long (outside-to-outside).

  • Foundations must be level and square.

b. Upgrade Option – Interior Anchor System (Additional Fees Apply):

  • Units installed on a concrete foundation with the upgraded interior anchor system (see page 6 for details) require a foundation that matches the exact footprint of the building.

  • Example: A 12′ x 21′ unit (20′ base rail) requires a foundation measuring exactly 12′ wide x 20′ long (outside-to-outside).

  • Foundations must be level and square.

c. Dirt, Gravel, or Asphalt Installation:

  • Units installed on these surfaces will be secured with temporary pin anchors only.

  • These anchors pin the unit in place but do not protect against wind uplift.

  • To meet ISBC’s minimum wind rating requirements, the Customer must upgrade to mobile home anchors, rock anchors, or asphalt anchors.

  • If the Customer declines the upgrade, all warranties will automatically be voided.

d. Other Surfaces:

  • Any other type of surface will be evaluated on a case-by-case basis.

  • Additional pricing will be provided by an ISBC authorized dealer.


4. Layout of Structures

a. Height: The listed height is measured by side-wall/leg height, not the peak. Peak height varies depending on roof style and width.

b. Length: Includes a 6″ overhang on the front and back ends, with a roofline that is 1′ longer than the base rail.

  • Example: A 21′ building has a 20′ base rail.

  • On vertical roof styles, there is a 6″ overhang at the front and back.

c. Ends/Sides: The front and back of the unit represent the width, while the sides represent the length. Dimensions are measured outside-to-outside.


5. Customer Responsibilities

a. Site Measurements:

  • ISBC does not install pads. The Customer is responsible for ensuring the site dimensions match the order.

  • If the unit does not fit, a 25% restocking fee will apply in addition to costs for structural changes.

  • For side/end panels, at least 3′ of clearance around the structure is required.

b. Leveling:

  • The installation site must be level within 2″ (side-to-side and front-to-back).

  • If not level, a leg-cutting fee will be applied based on slope and building size.

  • If installation cannot proceed, a $650 return trip fee will apply.

c. Site Clearance:

  • The site must be clear of vehicles, debris, and obstructions.

  • Fees:

    • Standby: $150/hour if the site is not ready on the scheduled day.

    • Build-over: $50 per 5′ of building length.

      • Example: A 21′ building incurs a $200 build-over fee.

d. Permits and Engineering:

  • The Customer must obtain all required permits before installation.

  • ISBC is not liable for ordinance or code violations.

  • Unless the Customer purchases a certified structure with engineered drawings, ISBC does not guarantee compliance with specific wind or snow load ratings.

e. Condensation Barriers:

  • Responsibility for condensation barriers lies with the Customer.

  • ISBC may supply these materials at additional cost.


6. Location of Underground Utilities

  • The Customer is solely responsible for identifying and marking all underground utilities (cables, gas lines, water lines, etc.) prior to installation.

  • This may include contacting the utility company for marking services.

  • ISBC is not liable for damage to unmarked utilities, or for damage to items/vehicles left at the job site.


7. Site Access

  • If the delivery/installation truck cannot access the site within 100′, a $250 labor fee will be added to the balance.

  • If the site is inaccessible, installation may be rescheduled and a $650 return trip fee will apply.

  • Customers with restricted installation times (e.g., businesses, HOAs) must notify ISBC prior to ordering, as this may affect pricing.


8. Equipment Rental Fee

  • The Equipment Rental Fee may be waived if the Customer provides their own lift equipment.

  • To qualify, equipment must meet the following minimum requirements:

    • 6,000 lb lift capacity

    • All-terrain capable

    • Minimum 42′ reach

  • Failure to meet these requirements will result in additional fees. If Needed*(Under 14 Feet Tall not Needed)

9. Payment Terms

  • A deposit of 10% (minimum, not to exceed 20%) is required to enter your order into ISBC’s system.

  • A 50% progress payment is due at the time of manufacturing. (Note: credit cards cannot be used for manufacturing payments.)

  • 25% is due upon arrival on the installation date.

  • The final 25% is due upon completion of installation. Accepted methods of payment include cash, check, or credit card.

  • A 3% convenience fee applies to all credit card payments.

  • ISBC reserves the right, at its sole discretion, to require additional deposits or modified payment schedules.


10. Refunds and Cancellations

a. Post-Manufacturing Cancellations:

  • Once manufacturing has begun, orders may not be canceled.

  • If a job is canceled on-site or after manufacturing has started, a 50% cancellation fee will be due immediately.

b. Pre-Manufacturing Cancellations:

  • If an order is canceled before manufacturing, Deposits are refundable if the building permit is denied by the county. Icon Steel  will refund the deposit amount, minus any transaction fees and any plan fees incurred, upon receipt of a denial letter from the county.

  • If permit was approved the deposit is non refundable. 

  • Deposits are non refundable as the deposits cover engineered drawings. 

  • If no drawings have been provided Refunds will incur a transaction fee equal to the greater of $50 or 25% of the deposit.


11. Prices, Payments, and Risk of Loss

a. Late Payments:

  • Any unpaid balance will accrue interest at 12% per annum or the maximum allowed by law, whichever is higher.

b. Breach of Agreement:

  • Failure to pay when due or to cooperate with ISBC’s performance obligations constitutes a breach by the Customer.

c. NSF Checks:

  • Returned checks (NSF) will incur a $50 service charge and any additional costs allowed by law.


12. Delivery and Inspection

a. Delivery Scheduling:

  • Shipping and installation dates are estimates only, based on ISBC’s current engineering and manufacturing capacity.

  • Dates are approximate and computed from the date ISBC enters the order into its system.

  • Scheduling depends on ISBC’s receipt of required documents, deposits, and approvals.

b. Delays Beyond ISBC’s Control:

  • ISBC is not liable for delays due to weather, natural disasters, strikes, accidents, transportation disruptions, government actions, or other events beyond ISBC’s control.

c. Customer Delays:

  • If shipment or performance is delayed at the Customer’s request or fault, ISBC may:

    • Hold the goods at the Customer’s risk and expense, or

    • Require immediate shipment.

  • Full and final payment will be due within 30 days of notification that goods are ready for shipment.


13. Limited Warranty

a. Certified Units:

  • 20-year limited warranty against rust-through on framing material.

  • 1-year manufacturer’s warranty for workmanship defects from the date of installation.

  • 40 Year Roof Warranty and 40 Year Wall Warranty 50 Year Structural Warranty

b. Non-Certified Units:

  • 30-day limited warranty only.


14. Warranty Disclaimer

There are no warranties beyond those stated herein. All other warranties, express or implied—including merchantability or fitness for a particular purpose—are expressly disclaimed.


15. Exclusive Remedy

The Customer’s sole and exclusive remedy shall be limited to the repair or replacement of nonconforming goods, provided ISBC is notified in writing within the warranty period.

  • ISBC’s liability will not exceed the purchase price of the goods.

  • This remedy will not fail its essential purpose so long as ISBC is willing and able to repair or replace defective parts.


16. Limitation of Liability

  • ISBC’s maximum liability, whether arising from breach of contract, warranty, negligence, strict liability, or other tort, is limited to the purchase price of the goods.

  • ISBC will not be liable for incidental, indirect, consequential, special, or exemplary damages, including but not limited to lost profits, lost revenues, or labor charges.


17. Warranty Limitations

  • Warranties extend only to the original purchaser.

  • Installation of ceiling fans on the structure voids all warranties.

  • Any modification, addition, or alteration without ISBC’s written approval voids the warranty.

  • Self-installation voids all warranties. Only ISBC-trained crews are authorized installers.


18. Claims Procedure

  • Claims must be submitted in writing within 30 days of discovering the defect to:

  • Claims must include:

    • Description of the defect

    • Proof of purchase

    • Installation address

  • ISBC must be given the opportunity to inspect the defect within 14 days. No repairs may begin prior to inspection, or the warranty may be void.


19. Custom Designs and Intellectual Property

If goods delivered include custom designs, ISBC retains all rights, title, and interest worldwide, including all intellectual property rights. The Customer hereby assigns any rights they may have in such designs to ISBC.


20. Governing Law

This Agreement is governed by the laws of the State of Florida.
The parties consent to jurisdiction in the courts of Palm Beach County, Florida and waive any rights to request venue elsewhere.


21. Mandatory Arbitration

  • All disputes shall be resolved by binding arbitration in Palm Beach County, Florida.

  • Arbitration shall be conducted under the Comprehensive Arbitration Rules and Procedures (including Expedited Procedures).

  • Judgment on the award may be entered in any court with jurisdiction.

  • Either party may seek provisional remedies from a court if necessary to aid arbitration.


22. Arbitration Costs and Attorney’s Fees

The unsuccessful party in arbitration shall bear all arbitration costs, court costs, and reasonable attorney’s fees, as determined by the arbitrator.


23. Social Media Policy

The Customer agrees not to post false, misleading, or defamatory statements regarding ISBC or its services.
The Customer grants ISBC permission to use photographs and videos of the installed structure for marketing, social media, and website purposes.


24. Entire Agreement

This Agreement, including any order forms, exhibits, invoices, and amendments, constitutes the entire agreement between the parties.

  • It supersedes all prior oral or written agreements.

  • Amendments may only be made by a written instrument signed by both ISBC and the Customer.


25. Headings

Headings are for reference only and do not modify or limit any provisions of this Agreement.


26. Severability

If any provision of this Agreement is found invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.


27. Waiver

No waiver by either party shall be effective unless in writing and signed by the waiving party. Failure to enforce any provision does not constitute a waiver of future enforcement.

Optional Upgrades & Add-Ons

Below is a list of available upgrades that do not come standard with our buildings. If you’d like pricing or have questions about any of these options, please let us know. Thank you!


Base Rail Seal

Our standard metal base rail anchors directly to the concrete slab and is not watertight, which may allow water seepage. A seal/caulking can be applied around the base rail to help prevent leaks—especially useful if the slab is larger than the framing.

Foam Strips

Installed at corners and eaves behind trim, these strips help block dirt, insects, and small critters, while also improving water resistance.

Skylights

Polycarbonate, ribbed, opaque skylight panels (roof only). Available for vertical-style roofs only.

Interior Anchors

Used when the concrete foundation is the same size as the unit. Standard anchors must sit 2–4″ from the slab edge to avoid “blowouts.” Interior anchors provide proper spacing and allow siding panels to extend past the slab edge for improved water drainage.

Colored Screws

Standard screws are silver/zinc. Upgrade to color-matched screws for a cleaner, more uniform appearance.

26-Gauge Paneling

Standard roofing/siding is 29-gauge. Upgrade to stronger 26-gauge PBR paneling with a larger rib profile for enhanced durability.

Insulation

A bubble-film barrier with a white polyethylene finish, installed between framing and panels before siding/walls are fastened. Available only with vertical-style roofs. (Not compatible with Skylights or Foam Strips.)

Vertical Siding

Standard siding runs horizontally. Upgrade to vertical siding for a premium look. Requires a laser-leveled slab cut to the exact size of the framing/base rail.

Wainscot Option

A two-tone look achieved by applying a different color to the bottom 3′ of siding.

  • Horizontal siding: Included at no extra charge.

  • Vertical siding: Available with an additional upcharge.
